These terms govern your use of Brite Bird. By creating an account, requesting an estimate, purchasing an installation, or using the Brite Bird app or dealer portal, you agree to them. If you do not agree, do not use the service.
Brite Bird is operated by Brite Bird LLC ("Brite Bird," "we," "us"), a limited liability company organized in the United States. Contact: developer@brite-bird.com.
You must be at least 18 years old to create an account. You are responsible for keeping your login credentials secure and for everything done under your account. Notify us immediately at the email above if you suspect unauthorized access.
We may suspend or close accounts that violate these terms, misuse the service, or expose Brite Bird or other users to legal risk.
Estimates are non-binding and based on the information you provide. Final pricing is set by your local certified dealer after an on-site walk-through. Payment terms, deposits, and financing options are arranged directly with your dealer.
If you finance through one of our partners (e.g., GreenSky, Synchrony), your agreement is with the finance provider. Brite Bird is not a lender and does not make credit decisions.
Brite Bird installations carry a five-year limited warranty covering defects in workmanship and weather-related failures of the track and bulbs, when installed by a certified dealer. The warranty transfers to new homeowners at no cost when the property is sold.
The warranty does not cover damage caused by accident, modification, unauthorized servicing, acts of nature outside the rated operating range (-40°F to 150°F), or removal by anyone other than a certified dealer. Claims are handled through the certified dealer who performed the original installation. Full warranty terms are provided with your installation paperwork.
You may use the Brite Bird app for personal, non-commercial control of Brite Bird lighting you own or have authorized access to. You may not:
The scenes, schedules, photos, and notes you create in the app belong to you. You grant Brite Bird a limited, worldwide, royalty-free license to host, back up, and display them as needed to operate the service for you.
Brite Bird, the Brite Bird logo, the Ray mascot, and all related designs and content are owned by Brite Bird LLC. You may not use our trademarks or copyrighted work without written permission, except to refer to Brite Bird accurately (for example, as a customer reviewing the product).
The app can integrate with third-party services like Amazon Alexa and Google Home. Those services have their own terms and privacy practices, which apply when you use them. We are not responsible for their availability or behavior.
The service is provided "as is." Brite Bird does not guarantee that the app or cloud features will be uninterrupted or error-free. Outdoor lighting is subject to weather, power outages, and network conditions; we recommend you treat Brite Bird as a lighting amenity, not as a safety or security system.
To the fullest extent allowed by law, Brite Bird's total liability to you for any claim arising out of or related to the service or these terms is limited to the amount you paid Brite Bird in the twelve months before the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
Some states do not allow certain limitations; in those cases, the limits apply to the maximum extent permitted.
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally will be heard in the state or federal courts located in Maricopa County, Arizona, and you agree to personal jurisdiction there.
We may update these terms from time to time. If changes are material, we will notify you by email or in-app notice at least 15 days before they take effect. Continued use after that date means you accept the new terms.
